Just In:Supreme Court disappoints Abacha’s family, refuses to unfreeze accounts in Switzerland, UK, and others

The family of the late Head of State, General Sani Abacha lost, on Friday, its bid to regain access to the many accounts held by its members in banks in the United Kingdom, Switzerland, Jersey, Liechenstein and Luxembourg blocked upon a directive by the Nigerian government in 1999.

A five-man panel of the Supreme Court held, in a judgment on Friday, that it was too late for the Abacha family to query the decision taken by the Federal Government of Nigeria in 1999, via a letter authored by the then Minister of Justice and Attorney-General of the Federation (AGF), Kanu Agabi (SAN).

Justice Chima Nweze, who authored the panel’s lead judgment. in the appeal marked: SC/68/2010, held among others, that in view of the evidence presented by parties, he was left with no other options than to uphold the earlier concurrent decisions of the two lower courts (the Federal High Court, Kano and the Court of Appeal, Kaduna division), to the effect that the action was statute barred.

Justice Nweze was absent at the court’s proceedings on Friday but had his lead judgment read by Justice Amina Augie, who quoted him as saying: “In all forms, with the eloquent submission of the respondents’ counsel, and submissions anchored on the admitted evidence, I have no hesitation in affirming the concurrent decisions of the lower courts.

“Accordingly, I hereby enter an order dismissing this appeal. I further affirm the concurrent findings and decisions of the lower courts. Appeal dismissed.”

According to court documents, the President, Olusegun Obasanjo, in December 1999, authorised the then AGF, Agabi to request the Swiss authorities to freeze all bank accounts held in its jurisdiction by the late Head of State, General Abacha, his children, servants, agents and any other individuals or companies liked to them between 1993 and 1998.

The Nigeria government was also said to have requested the Swiss authorities to seize and detain all banking and other documents relating to the affected accounts, charge and prosecute all holders of such accounts, in order to recover and pay over to the Federal Government of Nigeria all monies falsely and fraudulently taken from the government and people of Nigeria.

Also, the FG was said to have engaged a foreign financial investigator, Enrico Monfrini of Hauchomann & Bottage in Geneva, Switzerland, to assist in recovering “all looted monies by Gen Abacha and his family members and other public servants and third parties who have used their position or participated as accomplices to misappropriate public funds.”

Following these steps by the Federal Government, the accounts of the Abachas found in Switzerland, United Kingdom, Jersey, Liechenstein and Luxembourg were frozen, an action members of the late Head of State challenged by filing a suit, marked: FHC/KN/CS/6/2004, on January 28, 2004 before the Federal High Court, Kano.

The suit filed on behalf of the Abachas by Alhaji Abba Mohammed Sani, had the President of the Federal Republic of Nigeria and the Attorney General of the Federation as respondents.

After hearing parties, the court rendered its judgment in 2006, in which it upheld the argument by the respondents to the effect that the case was not only statute barred, the plaintiff could not relitigate the same case that had been decided by the court’s Abuja division in suit: FHC/ABJ/CS/347/2001brought by Sulgrave Holdings Inc & 19 others against the FRN & three others.

Alhaji Sani appealed the decision of the Federal High Court, Kano at the Court of Appeal, Kaduna. But in its judgment on December 15, 2009, the appellate court upheld the decision of the trail court and dismissed the appeal, a decision Alhaji Sani again appealed to the Supreme Court, which the apex court dismissed on Friday.

Other members of the Supreme Court’s five-man panel that heard the appeal, Justices Olukayode Ariwoola, Kudirat Kekere-Ekun, Augie and Paul Galumje, all agreed with the lead judgment as written by Justice Nweze. (The Nation)

Lagos state releases 65 new buses

Boko Haram: Buhari Govt. Condemns Murder Of Over 40 Borno Farmers

The President of Nigeria, Mr Muhammadu Buhari, has reportedly expressed grief over the killing of farmers on rice fields at Zabarmari, in Jere Local Government Area of Borno State, describing the terrorist killings as insane.

In his words; “I condemn the killing of our hardworking farmers by terrorists in Borno State. The entire country is hurt by these senseless killings. My thoughts are with their families in this time of grief. May their souls Rest In Peace.”

President Buhari further explained that the government had given all the needed support to the armed forces “to take all necessary steps to protect the country’s population and its territory.”

Juicy Update had reported that at least 44 rice farmers were killed by suspected members of the Boko Haram while harvesting their crops on Saturday.

Sources in Zabarmari, a Borno community known for rice farming, informed PREMIUM TIMES the farmers were attacked as they were working on a rice field at Garin Kwashebe.

It was learnt that the farmers were attacked on Saturday as residents of the state were voting to elect local government council officials, for the first time in 13 years.

The sources said the farmers “were rounded up and summarily slaughtered by the armed insurgents”.

Hassan Zabarmari, a former chairman of a rice farmers association in Borno State, confirmed the incident to security officials.

“It was a sad incident that took place at about 11 a.m today,” he said Saturday. “The farmers were attacked at the Garin-Kwashebe rice field, and according to reports reaching us since afternoon, about 40 of them were killed.”

“But we have been receiving conflicting information on the casualty figures – some said it was up to 50 farmers that were slaughtered.”

A member of House Representatives, Ahmed Satomi, who represents Jere federal constituency also confirmed the incident in an interview with PREMIUM TIMES.

“It was a very sad development that happened today at Zabarmari rice field general area,” he said.

“Farmers and fishermen were killed in cold blood. We have so far received 44 corpses from the farms and we are preparing for their burials tomorrow by God’s grace.”

The lawmaker said the farmers “were attacked because they had on Friday disarmed and arrested a Boko Haram gunman who had been tormenting them.”

Yet to be identified gunmen have shot dead a cleric, Revd Johnson Oladimeji, along Igbara-Odo- Ikere-Ekiti road in Ikere local government area of Ekiti State.

According to reports, Revd Johnson Oladimeji, a presiding cleric of Solution Baptist Church Ikere-Ekiti was said to have been killed along the road by gunmen suspected to be kidnappers around 5pm when he was returning to Ikere-Ekiti after an official assignment in Osun State.

A source in his church who spoke on conditions of anonymity said the family members launched a search for the pastor on Friday before his corpse was found in his car along the road with gunshot wounds.

The source said, “The man was returning from Osun State on Thursday evening and decided to make use of the Igbara-Odo route to Ikere-Ekiti when he was ambushed and shot dead by gunmen in the evening.

“After a series of calls to his phone numbers with no response, members of the church decided to start searching for him and he was found dead this evening in his car along the road close to the University of Education and Technology in Ikere-Ekiti.”

The source explained that the incident was reported at the Igbara-Odo police station before his corpse was evacuated to the morgue.

Confirming the killing, the President of Ekiti Baptist Church, Revd Adeyinka Aribasoye said the deceased had traveled to see his mother at Ipetu Ijesa in Osun State and was returning from the journey when the incident occurred.

He said, “The incident is synonymous to a kidnapping case that went wrong, maybe he refused to stop for the abductors thus making them open fire on him.

“The family were already expecting him but when they found out that he was taking too late they began to make a series of contacts and search before they found out that he had been killed on the road.”

But, the Police Public Relations Officer (PPRO) ASP Sunday Abutu told journalists he was not aware of the incident.

According to him,” I am not aware of such an incident, I will have to make my findings. But I can assure you that if we are informed of the incident, our command will commence Investigation immediately in a bid to arrest the perpetrators of the dastardly act.”

The Commander of 81 Division of the Nigerian Army, Mr Ibrahim Taiwo, revealed this on Saturday while testifying before the judicial panel the Lagos State Government set up to probe the incident.

On the night of 20 October, 2020, at about 6:50pm, operatives of the Nigerian Army opened fire on peaceful# EndSARS protesters at the toll gate, killing an unconfirmed number of people.

Despite evidence of people being killed and injured at the Lekki incident, the army had maintained that blank bullets were used on protesters.

While being cross examined by Olumide Fusika, a Senior Advocate of Nigeria (SAN), Taiwo said given the same circumstance, the army would act in a similar way to that of October 20, 2020.

He insisted that there was no shooting of live ammunition at protesters.

The President Muhammadu Buhari-led administration has asked that the Government of the United Kingdom (UK) tender an unreserved apology over allegations made by a UK parliamentarian against Former Nigerian Head of State, Yakubu Gowon.

Demanding an immediate apology in a statement by Ferdinand Nwonye, the Spokesperson of the ministry of foreign affairs, Nigerian authorities also asked that the allegations against Gowon be retracted.

“The Ministry of Foreign Affairs, through the Nigerian High Commission in London, immediately sought an apology and retraction of the unsubstantiated allegation from the British Government,” the statement said.

It will be recalled that Tugendhat had accused the former military head of state of looting Nigeria’s treasury.

Juicy Update gathered that Mr Tugendhat made the accusation during the British parliament debate on sanctions against political leaders and individuals involved in human right abuses during the EndSARS protest in Nigeria.

While reacting to the claims, Gowon said there are available records to prove he served Nigeria diligently, “What the MP said is rubbish. I don’t know where he got that rubbish from. I served Nigeria diligently and my records are there for all to see.

“I did not want to speak on this issue because people that know me know that what the MP said is not true.” Gowon told the BBC.

Also coming to the defence of Gowon was the President of African Development Bank, Akinwumi Adesina who stated that Gowon is a man of integrity and Nigerians should be careful of misinformation.

It was learnt that the victim’s mother left her when she was six months old and the father started having sexual intercourse with his daughter when she was 10 years old.

According to reports the rape saga was exposed when the victim opened up at a students’ fellowship that somebody was already having sex with her.

She was said to have narrated that her father would demand sex anytime she requested money from him for school fees, self-medication, books, or personal upkeep.

The court was informed that it was the victim’s school principal that reported to the police before her father was arrested but pleaded not guilty to the one-count charge of rape preferred against him.

In his judgment, Justice Bola held that the evidence of the victim that the defendant demanded sexual intercourse from her before he acceded to her requests was true.

Justice Bola added that the defendant did not adduce any oral evidence to deny the evidence of his daughter or defend himself.

He found the defendant guilty as charged and sentenced him to life imprisonment.

In a statement, signed by the Deputy National Leader of BNL and Head of Operations, BBS Media, Ebuta Akor Takon, the group described the Governor as a talkative who lacks focus.

BNL accused Wike of trying to create ethnic tension in the State, adding that the Governor who denied being Igbo does not know the history of Rivers State and Niger Delta as a region.

The group pointed out that it was not possible for any group to rename a town if the indigenes of such town are not involved.

“The Governor does not have a tribe and acts as confused person,” the group said, insisting that the, “Niger Delta region of today includes Imo and Abia and they joined region same day Edo, Ondo, Cross River and Akwa Ibom States were included.

“We were never part of Niger Delta, it is an Ijaw region by geographical definition, it was Obasanjo that created this confusion when he added other areas as part of the region.

“If Wike said he has found a new ethnic group, and that he is not from Igbo because they told him that Ikwere is from Benin, it’s fine.

“But then, he shouldn’t forget that Late Oba of Benin rejected the claim, saying that the Benin Kingdom does not have any record showing that Ikwere migrated from Benin. They do not speak related language or practice the same culture.

“So you can see he doesn’t know anything, and he is a Governor. He merely relied on what some of the elders in Rivers State told him, and these were the same elders that looted Igbo property during the war.

“Being a Niger Deltan does not call for ethnic denial, everyone in Nigeria knows Wike is an Igbo man who is ignorant of that, he also does not know the meaning of his names. A full-fledged man like him does not know his ethnicity, it’s a shame.”

BNL claimed that Wike has no other agenda in his state other than talking about the activities of the Pro Biafra groups.

The Academic Staff Union of Universities, ASUU, has agreed to call of its eight-month strike which has grounded academic activities in the public universities.

This is coming barely 24 hours after kidnappers killed traditional ruler of Ifon, Oba Isreal Adeusi, the Olufon of Ifon.

Ale’s wife was reportedly kidnapped at Owena area of the state on Thursday night.

It was learnt that the kidnappers were yet to make demand for ransom payment.

Niger State has said Civil servants will not be receiving their full salaries, as the state government cites a reduction in its federal allocation, Juicy Update reports.

The state government disclosed that it would not be able to pay 100 percent of the salaries of its civil servants.

In a statement issued by the Secretary to the Niger State Government, Mr Ahmed Ibrahim Matane, the state would pay only 70 percent of salaries.

Ahmed statement reads in part, “What we discussed with the organized Labor was that because of the recession, our FAAC allocation has dropped to a level where we would not be able to pay 100 percent of the salary.

“We called their attention to this, we opened our books in terms of how much we received, the existing commitments and what is left over.”
